Victim Representation

The victim must have a qualifying relationship with the defendant(for example: spouse, child, parent, sibling, significant other), and also has the burden to establish that:
1. The defendant committed one or more of the predicate acts of domestic violence identified in the Prevention of Domestic Violence Act; and
2. There is a need for the protection of an FRO going forward.
If a victim is okay with the communication under almost any circumstance, it is likely the court will not grant a final restraining order.
